THE ISSF HEARING PROCESS

Therapeutic Use Exemptions

The Shooter or his/her Member Federation must inform the ISSF if a Therapeutic Use Exemption (TUE) has been granted permitting the use of the substance detected in the positive test. If a TUE has been granted, this will eliminate the anti-doping rule violation for that substance.

 

REMEMBER: The ISSF does not grant TUE’s for beta blockers to any Shooter competing at the international level and the ISSF shall never recognize a national level TUE for beta blockers granted to an international level Shooter for any ISSF sanctioned event. An adverse analytical finding for a beta-blocker will usually result in a 2 year sanction and suspension.

 

If a TUE has not been obtained but the application process for a TUE is underway, provide all relevant details to the ISSF regarding why the TUE has not been obtained. The ISSF Anti-Doping Rules could allow for a retroactive approval of a TUE in the case of asthma medication, “medical emergencies” or “exceptional circumstances”.

Strict Liability

In compliance with the World Anti-Doping Code, ISSF has adopted the strict liability rule in all doping cases. This means that the mere presence of a prohibited substance or its metabolites or markers in a Shooter’s sample is an anti-doping rule violation. Shooters are personally responsible for the presence of all substances detected in their sample. A doping violation will be established if a prohibited substance is detected in any quantity in the sample regardless of the Shooter’s intent, fault, negligence or carelessness in connection with that substance.

ISSF Right of Review

When the ISSF is not the results management authority and does not conduct the hearing, in other words, when the adverse analytical finding derives from a national level test and a national level hearing panel renders a decision on a doping matter, or fails to render a decision on a doping matter, that decision is subject to a review by the ISSF Executive Committee in accordance with article 5.16 of the ISSF Anti-Doping Rules.

 

The ISSF  Executive Committee’s right to review a decision, or lack of a decision, that is clearly not in compliance with the Code is consistent with the requirement that the principles of the ISSF Anti-Doping Rules and the Code must be respected and properly implemented.
